（一）公务员依法行政能力的概念和基本内容

一般认为，公务员依法行政能力是指行政机关工作人员依据依法行政的原则和观念，按照法定职责和权限实施行政行为并承担相应行政责任的能力。

根据行政机关与公务员关系的一般法理，公务员作为行政机关的组成要素，本身不是行政机关，不具有独立法律人格，但行政机关的职权是通过公务员实施的。因此，公务员依法行政能力的强弱直接决定行政机关依法行政的水平。

相应地，对公务员依法行政能力的具体内容，也有不同认识。

（1）有较强的法律意识、规则意识、法制观念；

（2）忠实遵守宪法、法律和法规，按照法定的职责权限和程序履行职责、执行公务；准确运用与工作相关的法律、法规和有关政策；

（3）依法办事，准确执法，公正执法，文明执法，不以权代法；

（4）敢于同违法行为作斗争，维护宪法、法律尊严。

1、增强公务员依法行政观念和能力是全面推进依法行政、建设法治政府的迫切需要

改革开放以来，我国的行政法治建设取得了很大成绩，各级行政机关及其公务员的依法行政观念有所增强，依法行政能力有所提高。但是也应看到，当前的依法行政工作还存在不少问题，特别是公务员依法行政的观念和依法行政能力仍然是影响政府机关依法行政水平的制约因素。这就要求对公务员特别是行政机关的领导干部长期不懈地进行教育和培训，增强公务员法制观念，树立依法行政的正确态度，提高依法行政的水平。

2、增强公务员依法行政观念和能力是公务员能力建设的鲜明主题

公务员担负着改革开放和现代化建设的规划、组织和实施的重要责任，新形势和任务对公务员能力建设提出多方面的要求。公务员不仅要有较高的政治和业务素质，还要有较高的法律素质，无论是进行决策还是实施管理，都必须按照法律法规行使权力，合法有效地运用权力。特别是随着改革开放的深入发展和市场经济的不断完善，法律已经成为国家政治生活、社会生活和公务活动的重要内容，依法行政已经成为政府工作的主要任务之一。公务员只有坚持依法行政，才能适应社会发展对公务员职位的要求和政府工作的需要。公务员的社会地位和职业特点决定了公务员必须学法用法，严格执法，这对于落实依法治国基本方略具有重要意义。
